Welcome to PoochBud.These Terms of Service ("Terms") govern your use of our website(PoochBud.com) and your purchase of products from us. By accessing the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
1. About PoochBud
PoochBud is an ecommerce store offering dog beds, harnesses, leashes, apparel, toys, and accessories. The site is operated through Shopify Inc.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering you confirm you meet this requirement.
3. Account and ordering
You may purchase as a guest or by creating an account. You are responsible for keeping your account credentials confidential and for all activity under your account. If you spot unauthorized access, email support@poochbud.com immediately.
4. Product information and pricing
We do our best to describe products accurately. Photos are representative; small variations in color, fabric, and finish are normal between batches. Prices are listed in US dollars or local currency at your location and may change without notice. If we discover an obvious pricing error on an order, we will contact you with the correct price before charging or processing the order, and you may approve, cancel, or modify the order.
5. Order acceptance
An order confirmation email is an acknowledgment that we received your order, not a contract of sale. We reserve the right to refuse, cancel, or limit any order at our discretion, including for suspected fraud, resale activity, pricing errors, or inventory issues. If we cancel your order for any reason, you will receive a full refund.
6. Payment
Payments are processed by Shopify Payments and other third-party processors. By placing an order you authorize us to charge the payment method you provide for the full order total, including any applicable taxes and shipping fees.
7. Shipping, returns, and refunds
Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy. Both are incorporated into these Terms by reference.
8. Intellectual property
All content on the site, including text, photography, product designs, the PoochBud name and logo, and the layout and look-and-feel of the site, is owned by Active Diamond Inc or its licensors and is protected by US and international copyright and trademark law. You may not copy, reproduce, scrape, redistribute, or use our content for commercial purposes without prior written permission.
9. Customer content
If you submit a review, photo of your dog with our products, or other content to the site or to us by email or social media, you grant Active Diamond Inc a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business, including in marketing materials. You confirm that you own or have permission to submit the content and that it does not violate anyone's rights.
10. Product use and safety
PoochBud products are general pet supplies designed for everyday comfort, walking, and play. They are not medical devices and are not intended to diagnose, treat, or prevent any condition in pets.
If your dog has a known health condition, recent injury, or is recovering from surgery, consult a qualified veterinarian before using any PoochBud product. Stop use and seek veterinary attention if your dog shows discomfort, skin irritation, or unusual behavior while using the product.
Supervise your dog with new products. Inspect harnesses, leashes, collars, beds, and toys regularly for damage. Stop use immediately if you see fraying, broken parts, or chewed pieces that could be swallowed. Keep small parts and packaging away from puppies and small children.
11. Warranties and disclaimers
To the maximum extent permitted by law, the site and the products are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding fitness for a particular purpose, merchantability, non-infringement, or that the site will be uninterrupted or error-free. Some jurisdictions do not allow disclaimers of implied warranties, in which case the warranty disclaimers above apply only to the extent permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, Active Diamond Inc, its officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of or in connection with the site or products. Our total liability for any claim related to a product is capped at the amount you paid for that product.
Nothing in these Terms limits liability that cannot lawfully be limited, such as liability for fraud, gross negligence, death, or personal injury caused by negligence.
13. Indemnification
You agree to indemnify and hold Active Diamond Inc harmless from any claim, loss, or expense arising from your breach of these Terms, your misuse of the site or products, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Wyoming, without regard to conflict-of-laws principles. We will first attempt to resolve any dispute informally by email at support@poochbud.com. If informal resolution fails, the dispute will be brought exclusively in the state or federal courts located in Casper County, Wyoming, and you consent to personal jurisdiction in those courts.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the site after the change constitutes acceptance of the updated Terms.
16. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, are the entire agreement between you and PoochBud regarding your use of the site and purchase of products.
